  • Our estimates are educated guesses, not guarantees
  • Don't abuse our API or upload illegal content
  • We can cancel accounts that violate these terms
  • You own your data, we provide the tools

1. Agreement to Terms

By accessing or using HowMuchToFix ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part, you may not use our Service.

We reserve the right to update these Terms at any time. Major changes will be announced via email (if you're registered) or a banner on our website.

2. Using Our Service

You May:

  • ✅ Use our service for personal or commercial repair cost estimates
  • ✅ Upload photos of damaged devices for analysis
  • ✅ Ask our AI assistant repair-related questions
  • ✅ Share your carbon savings achievements
  • ✅ Use our calculators and tools for decision-making
  • ✅ Integrate our API if you have a Business subscription

You May NOT:

  • ❌ Upload illegal, harmful, or offensive content
  • ❌ Abuse our API (scraping, flooding, reverse engineering)
  • ❌ Resell our estimates without permission
  • ❌ Use our service to harm others or violate laws
  • ❌ Share your account credentials with others
  • ❌ Attempt to bypass usage limits or payment systems
  • ❌ Use automated scripts without a Business subscription

3. Estimates & Disclaimers

⚠️ Important Disclaimer:

Our AI-powered estimates are educated guesses based on historical data, not guaranteed quotes. Actual repair costs may vary by location, shop, device condition, and part availability.

Our Estimates Include:

  • Cost ranges based on thousands of real repair data points
  • Difficulty level and estimated repair time
  • Environmental impact calculations
  • Links to repair guides and local shops

We Are NOT:

  • A repair shop (we don't fix devices)
  • An insurance company (we don't cover repairs)
  • A warranty provider (we don't guarantee repairs)
  • Responsible for third-party repair shop quality or pricing

Accuracy: Our AI is typically accurate within 10-20% of final repair costs, but outliers happen. Always get quotes from actual repair shops before proceeding.

4. Subscriptions & Payments

Free Tier:

  • 3 photo analyses per month
  • 20 AI chat messages per month
  • Basic carbon tracking
  • Community support

Paid Subscriptions (Pro & Business):

  • Subscriptions renew automatically (monthly or yearly)
  • You can cancel anytime - access continues until period end
  • Refunds available within 30 days of purchase (email support)
  • Price changes: We'll notify you 30 days before any increase
  • Failed payments: Service paused after 3 attempts, then downgraded to Free

Business API Access:

  • Subject to rate limits (10,000 calls/month for Business tier)
  • Overages: Contact us for custom pricing
  • API keys must be kept secure - you're responsible for usage
  • Commercial use allowed with proper attribution

5. Intellectual Property

Our IP:

HowMuchToFix owns all rights to our service, including design, code, algorithms, branding, and content we create. You may not copy, modify, or redistribute our service without written permission.

Your Content:

You retain ownership of photos and data you upload. By using our Service, you grant us a limited license to:

  • Process your photos with AI for repair analysis
  • Store your estimates and chat history (if you have an account)
  • Use anonymized data to improve our AI models
  • Display your carbon savings achievements (with your permission)

Third-Party Content:

  • Repair guides from third-party providers: Licensed content used with permission
  • Device data from manufacturers: Used under fair use
  • Environmental impact data: Sourced from industry-standard databases

6. Limitation of Liability

Legal Disclaimer:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOWMUCHTOFIX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In plain English:

  • We're not responsible if a repair shop quotes higher than our estimate
  • We're not liable for device damage during repair by third parties
  • We don't guarantee uptime (though we try our best!)
  • Our maximum liability is limited to what you paid us in the last 12 months

7. Account Termination

We May Suspend/Terminate Your Account If You:

  • Violate these Terms of Service
  • Abuse our API or service
  • Upload illegal or harmful content
  • Commit fraud or payment abuse
  • Harass our team or other users

You May Cancel Anytime:

  • Go to Dashboard → Settings → Cancel Subscription
  • Access continues until your billing period ends
  • Data retained for 30 days, then permanently deleted (unless required by law)
  • Refunds: Within 30 days of purchase, email support@howmuchtofix.com

8. Governing Law & Disputes

These Terms are governed by the laws of [Your State/Country], without regard to conflict of law principles.

Dispute Resolution:

  1. Contact Us First: Email support@howmuchtofix.com - we'll try to resolve it
  2. Mediation: If that fails, we'll try mediation before legal action
  3. Arbitration: Disputes resolved through binding arbitration (not court)
  4. Class Action Waiver: You agree not to participate in class-action lawsuits

Exception: Small claims court (under $10,000) is allowed in your jurisdiction.

9. Miscellaneous

Entire Agreement:

These Terms, along with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and HowMuchToFix.

Severability:

If any provision is found unenforceable, the rest remains in effect.

No Waiver:

Our failure to enforce any right doesn't waive that right.

Assignment:

We may transfer our rights/obligations (e.g., if we're acquired). You may not transfer your account without our permission.
